There was a motion to accept the minutes of the February 21st meeting with 2 changes.  The motion was seconded and accepted with a vote of 5-0-0.
                                            
Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

Mr. Alfieri presented the Commission with a letter from Cavallaro Signs with an estimate to fix the DelCarte sign with two different options.  The Commission authorized Mr. Alfieri to have Mr. Cavallaro glue and repair the sign at the DelCarte property.  

There was a motion to approve $140 in total; $40 for AMWS membership for Mr. Alfieri and $100 for Mr. Alfieri to attend the Stormwater Regulation Workshop on March 25th.  The motion was seconded and accepted with a vote of 5-0-0.


Public Hearing – Amendment Request – Chestnut Senior Village – Ranieri – SE159-918

Mr. Donald Nielsen, Engineer of Guerriere & Halnon, and Mr. Donald Ranieri, Jr., the applicant, both appeared before the Commission for the construction of 1 ten-unit building and reduction of impervious surface by 2,800 square feet for senior citizens.  Mr. Nielsen informed the Commission that he is appearing at tonight’s meeting to seek an Amendment to the existing Orders of Conditions for the project.

Mr. Nielsen presented the Commission with revised plans for the project and informed the Commission that this revised plan is for one building of ten units as opposed to five buildings with two units each.  There would be no altering of the 25 ft. buffer established by the Commission with all of the proposed plantings along the base of the retaining wall still remaining in place.  There is also less impervious area on the site.  The drainage would still remain the same.  There would still be access to the sewer easement as depicted on the original plans.  These issues would result in less impact to the resource area as was approved in the original Orders of Conditions.  There will be the same drainage system as was originally proposed.

Mr. Alfieri informed the applicant of 3 items to be addressed in this amendment request filing.

Mr. Nielsen stated that this project complies with the minimum requirement under the Open Space or zoning requirement.  There are 4 acres that the Town has requested be provided as Open Space for the purpose of protection.  Of the 9 acres on the site, the applicant is proposing building on approximately 1.5 acres, the remainder of the site is to be protected.

A Commission member suggested some different species of plantings for the site from what is being proposed on the plan to achieve a better success rate.

A Commission member questioned the location of the snow storage and does not want to see snow stored in the resource area.

Another Commission member stated that according to the USGS map, a pond is shown on the site and questioned whether that pond is still currently located there.  Mr. Nielsen stated that he has never entered that far into the site.

Mr. Dan Page, an abutter of 67 Milliken Avenue, stated that at the rear of his parking lot, there are ducks and questioned as to where they are coming from.  He questioned how much distance
there is from the wetlands on the site to the wetlands near his home.  

Mr. Kevin Keefe, an abutter of 33 Chestnut Street, stated that nothing has changed in this plan from the original plan presented in 2006.

Mrs. Jean Dorr, an abutter of 57 Chestnut Street, expressed concerns regarding the existing of debris on the site and presented photographs of this to the Commission.  She suggested that the soils on the site be tested for contaminants.  There is also an abundance of mosquitoes on the site according to the Norfolk Country Mosquito Control.

Mr. Rose Turco, an interested citizen, expressed concerns and suggested that the soils be tested as this area was the site of dumping some years ago.  She also questioned the number of parking spaces proposed for the site.  

Mr. Jeff Corish, an abutter of 41 Chestnut Street, expressed concerns regarding the water runoff from Chestnut Street and the possibility of flooding.  

Mr. Nielsen requested that Mr. Alfieri write a comment letter to the Planning Board prior to next Monday night’s Planning Board meeting.

There was a motion to continue the hearing until March 20th.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to authorize Mr. Alfieri, Conservation Agent, to write a letter to the Planning Board supporting the 2 waivers being requested by the applicant Open Space for this site.  The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.

                  
GENERAL BUSINESS
        
        Discussion:  Forest Management Plan
        There was a motion to continue the discussion until the next meeting so that the        Commission member who requested this discussion is in attendance at the meeting.

        The motion was seconded and accepted with a vote of 5-0-0.
        
        Minor Buffer Zone Activity:  1 Wilson Road
        The applicant has requested the installation of a 15’x30’ above-ground swimming pool.  Mr. Alfieri stated that he revisited the site and inspected it and based on his findings, this work would take place outside the 50 ft. buffer zone; i.e., approximately 60 ft. from the wetlands.  Mr. Alfieri recommended that the Commission include a special condition regarding a non-chlorinated filtering system to be used in the pool.

There was a motion to issue a Negative Determination with 3 Special Conditions.  The motion was seconded and accepted with a vote of 5-0-0.

        Permit Decision:  DPW Garage Well Nos. 1&2 Work – CE159-961
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project.
        
There was a motion to issue standard State and Local Orders of Conditions for this project.  The motion was seconded and accepted with a vote of 5-0-0.

       Permit Decision:  Beaver Street Culvert Replacement – CE159-959
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project.
        
There was a motion to issue State and Local Orders of Conditions with 1 Special Condition for this project.  The motion was seconded and accepted with a vote of 5-0-0.

        Permit Decision:  Spring Street Roadway - CE159-951
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project.
        



There was a motion to issue State and Local Orders of Conditions with for this project with the standard and special Conditions that were just revised.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to issue State and Local Orders of Conditions with 1 Special Condition for this project.  The motion was seconded and accepted with a vote of 5-0-0.

There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project.
        
There was a motion to issue standard State and Local Orders of Conditions for this project.  The motion was seconded and accepted with a vote of 5-0-0.

        Comments
        
        A Commission member stated that he is requesting that the application submission        requirements be         revised so that an applicant will be required to submit sufficient copies       of the applications so that     the Commission has an opportunity to review the         project         before the meeting.  The        Commission Chairman requested that the applicants be    required        to bring in a display   board so that the audience can see the plans at the meeting.

        Mr. Alfieri suggested that a change to the regulations should be authorized by the      Commission at the next meeting and brought forth for motion and vote and will then      become policy for all future filings.

        Another Commission member suggested that the planting plans be better designed and      that the applicant be given some guidance as to the choice of plantings.
